Vending Machine Rental Terms

• Initial rental period ends at 9pm on the date following the date of rental.
• The applicable Initial Rental Rate (see table below) applies to the initial rental period. If you elect to keep a rental item beyond the initial rental period, you will be charged the applicable Extra Day Rate (see table below) for each additional rental period that you elect to keep the item.
• Each additional rental period also ends at 9pm. If you elect not to return a rental item by 9pm on the applicable Purchase Date (see table below), you will be charged the total extra day rental amounts due for the rental term, plus applicable taxes, and the rental item shall be considered purchased by you, at which time the item can no longer be returned.

• This vending machine is operated by NCR. Customer Service can be reached at 1-877-300-2128 from 9:00 am to 10:00 pm Monday - Friday and 12:00 pm - 10:00 pm Saturday - Sunday, EST 7 days a week.
• A valid credit card is required at time of rental.
• A maximum of 3 movies may be rented at a time.
• These rental terms and pricing are good at select participating BLOCKBUSTER Express™ vending machines only and are subject to change without advance notice at any time. Other BLOCKBUSTER Express™ vending machines may have different rental terms and pricing.
• Rental terms for BLOCKBUSTER Express™ vending machines differ from rental terms at BLOCKBUSTER© stores, do not require a BLOCKBUSTER© membership, and do not count as a BLOCKBUSTER© store rental or towards any BLOCKBUSTER© membership program.
• A BLOCKBUSTER Express™ rental item may be returned to any BLOCKBUSTER Express™ vending machine. DVDs and games rented from BLOCKBUSTER Online^® and BLOCKBUSTER© stores may NOT be returned to vending machines. Hours of operation may vary from day to day and by location.
• You authorize BLOCKBUSTER Express™ to use the credit or debit card information provided and submit credit or debit card charge slips and/or electronic payments using any credit card or check card information provided in collection of amounts owing, including amounts owing for failure to return product or damage to rental product. BLOCKBUSTER Express™ is in no way responsible for overdraft charges due to customer authorizations, rental periods, product purchases or any other circumstances.
• To fairly resolve any dispute arising between you and BLOCKBUSTER© and/or NCR ("BLOCKBUSTER©/NCR") regarding any transaction through a BLOCKBUSTER Express™ vending machine (including, without limitation, fees or any Blockbuster/NCR policies), you and BLOCKBUSTER©/NCR agree that any claims of these types by either you or BLOCKBUSTER©/NCR shall be settled exclusively by binding arbitration governed by the Federal Arbitration Act and administered by the American Arbitration Association under its rules for the resolution of consumer-related disputes, or under other mutually-agreed procedures. Because this method of dispute resolution is personal, individual and provides the exclusive method for resolving such disputes, you further agree that you will not participate in a class action or class-wide arbitration for any claims covered by this agreement.
• You agree to hold BLOCKBUSTER Express™, its kiosk host locations and its employees harmless from any damage or loss to any person or property arising out of the use of any product purchased or rented.
• BLOCKBUSTER Express™ may change these Terms and Conditions at any time and any new terms and conditions shall be effective upon the first product rented or purchased after any such change.
• You acknowledge that you have read these terms and conditions and agree that any rentals and/or purchases made by you through any BLOCKBUSTER Express™ vending machine are subject to these terms and conditions, which may be amended at any time by BLOCKBUSTER©/NCR without notice. YOU ACKNOWLEDGE AND ACCEPT FULL RESPONSIBILITY AND GUARANTEE PAYMENT FOR ALL ITEMS RENTED AND/OR PURCHASED THROUGH ANY BLOCKBUSTER EXPRESS VENDING MACHINE (Guarantee not applicable in California). You agree that BLOCKBUSTER©/NCR may pursue all avenues of collection, including use of collection agencies, and authorize BLOCKBUSTER©/NCR to prepare and submit credit card charges using the credit card(s) provided by you in any transaction through a BLOCKBUSTER Express™ vending machine to recover all charges and all other unpaid amounts due to (a) your election to not timely return all items rented, (b) damages to returned items (not to exceed the retail price of the item), and (c) other unpaid charges and reasonable legal fees resulting from your election to not return rented items.

Online Rental Terms

• In addition to the Vending Machine Rental Terms listed above, online rentals are subject to the following additional terms and conditions:
• You must complete the checkout process to rent a rental item on www.blockbusterexpress.com. Upon clicking "Complete Rental", your credit card will be charged for the first night's rental plus tax. You will be charged even if you do not retrieve the item from the kiosk. Your rental is valid only at the kiosk specified in your Cart and is non-transferable.
• Upon completing a transaction, your rental item will be held for you until 9 p.m. the next business day, and then will be released for others to rent.
• You have until 9 p.m. the next business day to pick up and return the your rental item. If you elect to keep a rental item beyond the initial rental period, you will be charged the applicable Extra Day Rate (see above) for each additional rental period that you elect to keep the item.
• All rentals are subject to the hours of kiosk availability, which are subject to change without notice.
• If a promotion code is used and the rental item is not picked up, you will be charged for one night's rental plus tax.
